A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer alien smuggling allegations, he was detained in federal detention.
In her order, the court noted that the authorities does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The legal challenge involve conflicting assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in the state of Tennessee.
Terms of Release
The court, who was overseeing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
This ruling marks a notable turn in a complicated immigration battle featuring claims of mistaken imprisonment and contested gang associations.
